Multi-District Cases

Multidistrict Litigation is litigation comprised of multiple civil cases involving one or more common questions of fact which have been transferred from different federal districts by the Judicial Panel on Multidistrict Litigation to a single federal district for coordinated or consolidated pretrial proceedings under 28 U.S.C. Plaintiff’s in these cases allege that Evenflo misled consumers to purchase its "Big Kid" booster seats by (1) claiming the seats were “side impact tested” and exceeded governmental standards, without revealing that Evenflo created its own test, which showed that a child seated in its booster could be in danger in a side impact crash; and (2) failing to inform consumers that the seats were dangerous for children weighing less that 40 pounds. These cases have been assigned to Judge Denise J. Casper.
